These Conditions of Sale regulate the contracts between buyers (hereinafter referred to as "Customers") and the company EMME CI S.r.l. with registered office in Milan postcode 20121 in Via Palermo 1 - VAT number 10890480154 C.F. (hereinafter referred to as "EMME CI"). Customers are advised to check the Conditions of Sale, as EMME CI may be obliged to modify them. By making purchases in this on-line shop, customers agree to abide by these terms and conditions.

1. Prices

The sales prices are indicated in Euros (€) excluding VAT. Any delivery costs are not included in the price and are always charged to the customers (unless otherwise specified).

The prices shown are valid exclusively for online purchases and may differ from those charged at our headquarters and BHC Milan showroom.

2. Product information

The photographs, whether they are of the product only or of the setting, do not in any way form part of the contract, and EMME CI S.r.l. is not responsible for their realization. The technical data sheets and product descriptions are provided by the suppliers of EMME CI S.r.l., which declines all responsibility for their content . The manufacturer's website will be solely responsible for customer information.

3. Availability

Orders are processed upon availability of the products at the manufacturing companies.

In case one or more products of the order are not immediately available, the order, even if paid, will be processed when all the goods are available. However, it will be taken care of, by the staff of EMME CI s.r.l.,inform the customer within the next 72 hours from receipt of payment, about any delay in delivery times. 

EMME CI is unable to guarantee that any reordering of sold out lots can be processed, in this case the stuff will notify the consumer, offering him a product of equivalent quality, aesthetic type and price. In case of no agreement, the refund will be made.

4. Terms of delivery

Our orders are shipped with couriers that carry out groupage services, to the customer's address and unloaded at street level.

Delivery times, if the material is available by the manufacturing companies, are approximately 15/20 working days, except (referred to in point 3).

If the address is located in areas with limited traffic or not accessible to courier, the customer is obliged to contact EMME CI S.r.l. to arrange a dedicated transport. EMME CI S.r.l. will notify the customer of the additional transport costs.

Please note that for large slabs packed on crates and trestles, street level unloading is not carried out, which must be provided by the Customer with his own means or workers.

EMME CI srl will not be in any way responsible for the consequences of delayed deliveries, loss or damage to the order by the courier.

The buyer must proceed, at the time of delivery, with all the necessary inspections to detect any damage, missing packages, defects or other apparent defects or non-conformity of the products delivered .

The buyer must verify that the number of packages corresponds to that indicated on the delivery document and that the packaging is intact.

In case that, at the moment of delivery, defects or breakages are found, they must be immediately reported to the courier who makes the delivery by accepting the goods with prudent RESERVE to be affixed to the D.D.T. or rejecting it in its entirety.

The customer must notify EMME CI no later than 48 hours from receipt of the goods (from the delivery date shown in the DDT) with an e-mail, supporting everything with appropriate photographic documentation of the material still on the pallet  (reporting already in the transport document the presence of breakages).

It is essential and therefore recommended, upon receipt of the goods still packaged (in most cases, not immediately controllable) to sign the transport document, always affixing on it - near your signature - the writing "with control reserve ".

The acceptance of products without reserve will cancel any possibility of complaint and / or replacement of the goods.

5. Payment

Payment must be made at the time of ordering by:

6. Right of cancellation Money-back guarantee

The buyer has the right of return, even without indicating the reasons, within 14 days, starting from the day on which he or a third party designated by him, other than the carrier, acquires physical possession of the goods, by sending an e-mail communication requesting the withdrawal from the contract.

7. Right of cancellation Money-back guarantee

7.1 Internet on-line sales are covered by the Legislative Decree no. 185 of 22/05/1999 regarding distance contracts, i.e. contracts agreed outside commercial premises (off-premises).

This regulation grants the right of cancellation, i.e. the right of the purchaser to return a purchased product and be reimbursed for the cost of the same. This right is reserved to natural persons only and cannot be exercised by legal persons or natural persons exercising functions related to their professional activities.

To exercise the right of cancellation, purchasers must return the goods for which they wish to exercise the right of cancellation to the address of EMME CI S.r.l. within 14 days from the date of receipt of the goods.

The costs of delivery to EMME CI S.r.l. are the sole responsibility of the purchaser.

The right of cancellation lapses totally if the product returned is incomplete and:

• The product is without the original packaging.
  
  
• Parts of the product (e.g. screws, clips, plugs, feet) are missing.
  
  
• The product is damaged.
  
  

Within 30 days of the date of despatch and in any case not before receipt of the returned product, EMME CI S.r.l. will issue an order to reimburse the credit.

EMME CI S.r.l. will reject deliveries of returned products which are incomplete and for which the delivery costs have not been fully paid by the purchaser.

Reimbursements are made by bank transfer. 

7.2 The parties hereby agree that the right of cancellation cannot be applied to sales on sample types, given that these types of sales are not distance sales. Customers may only request a reimbursement if there is a considerable discrepancy between the product delivered and the type sample. Flooring with large variations in colour shading may have parts with characteristic differences in appearance. (Customers are advised to visit producer sites to inspect the characteristic appearance of products).

7.3 The parties state and recognised that clause 7.2 above is subject to individual negotiation between the parties in accordance with Article 34, para 5 of consumer law.

8. Guarantees

The parties hereby agree and accept that the guarantees given above do not apply to sales on sample types as described in Article 6 above. Sales on sample types are not distance sales and in this case purchaser’s may only exercise the right of cancellation of the sales contract if there is a considerable discrepancy between the product delivered and the sample type.

9. Disputes and liability

EMME CI S.r.l. cannot be held liable for damage resulting from incorrect or improper use of the products sold on-line.

10. Personal data protection

EMME CI S.r.l. will require customers to provide the information necessary to confirm orders, issue invoices and fulfil contracts. Failure to provide the personal data requested will lead to cancellation of the order. Customers are under obligation to provide correct and true information.

11. Reviews

False, unsubstantiated reviews are liable to prosecution for defamation and unfair competition.
